Zonal High Court Judge Adam Mambi on Friday sentenced Yustine Robert, 32, to death by hanging for killing his wife Monica Lwiche, 25, and his children Frank,6, and Eliza, 4, on March 23, and dumping them into a water reservoir with intent to hide evidence in Sumbawanga, Rukwa Region. A man has been sentenced to death after the High Court found him guilty of killing his wife and two children.
Defence lawyer Patrick Mwakyusa pleaded with the court to free the accused, saying the persecution had not proved the case beyond reasonable doubt. He said there was no witness to prove that the accused actually killed his wife and children and threw them into the water reservoir.
However, prosecution lawyer Achiles Mulisi argued strongly against the defence, saying the landlord where the accused was renting rooms witnessed the incident. He added that there was evidence of verbal threats which the accused issued, proving that he actually committed the offence. He also said that the accused deliberately killed two of his children who were there, leaving the younger child who was not in the house at the time.
Judge, Mambi said the evidence provided from both sides necessitated the court to seek three things in the case—the circumstantial evidence, whether the persecution was able to prove the evidence and whether the accused had actually murdered.
Judge Mambi told the court that the prosecution had provided satisfying evidence to prove the murder case against Yustin Robert, as per Article Nos. The judge gave the chance to the accused to defend himself before the final verdict was read. Mr Mwakyusa told the court that the accused was guilty as charged by the quoted section of the law and there was nothing to ask the court in defence since the section of the law which was quoted left no option to the accused.
